The limitations of liability set forth in this section shall apply notwithstanding any failure of essential purpose of any limited remedy. Some jurisdictions do not allow the limitation or exclusion of liability for certain types of damages, so some of the above limitations may not apply to you.

The arbitration shall be conducted in the English language in Macomb County, Michigan, or, at your election, via telephone or videoconference. The arbitrator shall have the authority to award any remedy or relief that a court of competent jurisdiction could order or grant, except that the arbitrator may not award punitive damages except as expressly authorized by applicable statute. The arbitrator's decision shall be final and binding on both parties.

10.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Jet's Pizza agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

10.4 Exceptions to Arbitration

Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction. Either party may also seek emergency injunctive relief from a court of competent jurisdiction to preserve the status quo pending arbitration.
